GST Appeals Digest (October 2026): Limitation, Communication of Orders, Pre-Deposit and Hearing Before Appellate Authorities and GSTAT

With GSTAT now functioning across the country, procedural questions about appeals are coming up often. This digest covers eight recent rulings on when limitation starts, how pre-deposit is computed, when the department can appeal, the right to be heard, and the independence of tribunals.

Each entry links to our detailed post.

Key trends from these rulings

  • Limitation for appeal runs from real communication of the order, not mere upload or upload in a little-used portal tab (Manoj Spares, Elster Metering); but limitation does not wait for GSTAT to be constituted (Green Fizz).
  • Pre-deposit is cumulative and amounts already paid count towards the Tribunal pre-deposit (LTM); the 10% penalty-only pre-deposit does not apply to old proceedings (Hero Wiretex), and no 10% pre-deposit arises where no tax is confirmed (Groma).
  • The department cannot appeal to GSTAT below Rs 20 lakh unless an exclusion in Circular 207/1/2024 applies (Surya Business Combines).
  • First appellate authorities must hear the appellant even on threshold objections such as delay or authority (Groma).

Limitation and communication of orders

  • Rajasthan HC - Manoj Spares: Rajasthan HC (reportable): uploading an order on the GST portal is not communication under section 107(1); delay condoned and appeal sent back for merits.
  • Bombay HC - Elster Metering: Bombay HC revives GST appeal dismissed as time-barred: order uploaded in the 'Additional Notices and Orders' tab was not communicated under section 107(1).
  • Calcutta HC - Green Fizz Beverages: Calcutta HC rejects plea that limitation awaits GSTAT, but restores a delayed writ on a classification dispute subject to 20% deposit and bond.

Pre-deposit, hearing and monetary limits

  • GSTAT Chennai - LTM Ltd: GSTAT Chennai holds pre-deposit is cumulative: 10% paid for the first appeal covers section 112(8); ₹10.78 lakh appropriated, appeal to be admitted.
  • GSTAT Hyderabad - Hero Wiretex: GSTAT Hyderabad admits appeal against ₹30.34 crore penalty without pre-deposit: the 01.10.2025 proviso to section 112(8) does not apply to an SCN of 2021.
  • GSTAT Bengaluru - Groma Infrastructure: GSTAT Bengaluru restores appeal dismissed unheard, condones 21-day delay, finds no 'admitted' amount, but upholds Rs 43.93 lakh interest on late differential tax.
  • GSTAT Ernakulam - Surya Business Combines: GSTAT Ernakulam dismisses CGST appeal on interest of Rs 7.35 lakh: Circular 207/1/2024 bars department appeals to GSTAT below Rs 20 lakh unless an exclusion applies.

Tribunal independence

  • Supreme Court - Madras Bar Association: Supreme Court directions on the 2020 Tribunal Rules: a National Tribunals Commission, CJI-led selection committees, 5-year terms and advocates as judicial members.

What businesses should do now

  1. Record the date on which you actually learnt of each order; it may decide limitation.
  2. Before paying a fresh pre-deposit for GSTAT, check amounts already paid and link them through DRC-03A.
  3. If the department appeals on a small amount, check the monetary limits in Circular 207/1/2024.
  4. File condonation requests with clear reasons, and insist on a hearing before any dismissal.

Frequently asked questions

Does limitation start from the date an order is uploaded on the portal?

The Rajasthan and Bombay High Courts held it runs from real communication, not mere upload or upload in the additional tab.

Is pre-deposit required for an interest-only order?

GSTAT Bengaluru held no 10% pre-deposit is due under section 107(6)(b) where no tax is confirmed.
